The Seller is a developer and publishes Site rental services for the publication of nautical classified ads for consumers, marketed through its website (https://monbobateau.eu) below. after "MBB".
The list and description of the services offered by the Company can be consulted on the aforementioned site. These General Conditions of Sale (GTC) govern the sales of Services, made through the Company's website, and are an integral part of the Contract between the Buyer and the Seller. They are fully enforceable against the 'Buyer who accepted them before ordering.
The Seller reserves the right to modify these conditions at any time by publishing a new version on its website.
The GTC then applicable are those in force on the date of payment of the order.

The Company also ensures that their acceptance is clear and unreserved by setting up a checkbox and a link to this document when opening the Customer's account and when validating a transaction.
The Customer declares to have read all of these General Terms and Conditions of Sale, and to accept them without restriction or reservation. The Customer acknowledges that he has benefited, or has been able to benefit through the means of contact mentioned above, from the advice and information necessary to ensure the suitability of the offer to his needs. The Customer declares to be able to legally contract under French law or validly represent the natural or legal person for whom he is committed. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions. The prices of the services sold through MBB are indicated in net Euros, all taxes included (VAT + any other taxes) and precisely determined on the pages of descriptions of the Services.
They are also indicated in euros all taxes included on the product order page. For all services sold outside the European Union and / or DOM-TOM, the price is automatically calculated excluding tax on the invoice. In addition, customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the Seller. They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.).
The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities. The Company reserves the right to modify its prices at any time for the future. In accordance with the provisions of Article 1127-1 of the Civil Code (France)

- Prior to any use of MBB, and especially before any transaction, the Customer has made sure to have read and accepted the following documents, accessible at the bottom of each page of MBB:

          - The "Privacy Policy" of MBB:https://monbobateau.eu/en/misc/privacy

- The Customer must fill in his profile fairly in the "Profile" page of his account. He is informed that the contact details provided will appear on the corresponding invoice.
- The Choice of Service is offered:
          - Free access on the "Plans" page accessible directly from the home page
        - From his account, on the "Manage my plans" page.
In each of the two pages, the characteristics of each Service (hereinafter "Plan") appear in full in their description.
In the case of a renewal before the expiration of the Service, a discount in proportion to the time remaining may be indicated: the price to pay displayed takes this into account

The choice of Plan is made by clicking on a checkbox; are then displayed in the validation button area:
        - The price to pay
        - The validity period of the Plan from the moment.

The Customer must validate his choice to access the "Summary" page where he has access to:
        - His essential data: Email, name, address, company name for professionals, as well as a link to his profile to correct any errors
        - Reminder of the links to the following documents: CGV, CGU, Confidentiality policy.
        - A link to the Stripe operator (stripe.com) which manages the transaction
        - a button to check to access the banking form provided by the Stripe operator stipulating the waiver of the withdrawal period (see infra art. VII) and including a link to these GTC
        - A reminder of the characteristics of the chosen Plan, as well as its expiry date and its total price, all taxes included.
        - The payment form provided by the Stripe operator and integrated into the "Summary" page of MBB
The customer is informed on this same page that his bank details are processed by the Stripe operator; MBB acting only as a support.

Once the payment transaction has been initiated, following the response from the Stripe operator:
- Negative: the operation is canceled and the sessions relating to the transaction (Plan number, Plan price, MBB Transaction number linking the Client ID) are destroyed. The error message returned by the Stripe operator is then displayed
- Positive: A summary of the transaction is displayed, the provision of the plan is immediate and the Customer is informed, an invoice is created and made available in his "History" area; the message from the Stripe operator is displayed, a confirmation email is sent to the Client

Although for the sake of convenience of navigation, MBB offers several choices of languages, the language proposed for the conclusion of the contract is the French language.
An extract from these GTC is available to the customer on the public" Plans "page.

Detailed operation:
- Each plan includes one or more distinct locations displayed in the "Plans" and "My plans" pages, each accompanied by their characteristics and their price.
            - Designation of the Plan
            - Number of locations included in the Plan
            - Duration of the Plan
            - Number of Youtube video links
            - Presence or not of an XML feed
           - When applicable, "price per offer": The unit price displayed "per offer" is understood to be for each advertisement published within the framework of an optimal use of the plan concerned. < br>

  - Each location consists of an ad, unlimited photos and Youtube video link (s) (if included in the plan)
  - Each advertisement can be deactivated, replaced, edited or deleted at the Customer's convenience, without frequency limit; its photos and video links can be added or deleted in the same way.
  - The XML feed included in the "Course" plan offers the same operation.
  - The chosen plan can be modified at any time; Once expired, it can be renewed or abandoned, in the latter case its locations are then deactivated and kept for six months. After this period, they are automatically deleted.
  - The maximum capacity of the server for uploading images is fixed by security at 20 uploads simultaneously; however, the image management function has no addition limit.

  - The Customer is informed that no reimbursement will be due by GBNet in the event of a premature expiration of the need on the part of the Customer.
In accordance with Article L.411-1 of the Consumer Code (France), the services offered for sale through these GTCS meet the requirements in force relating to the safety and health of persons , fairness in commercial transactions and consumer protection.
Regardless of any commercial warranty, the Seller remains liable for any lack of conformity, as well as any malfunction, unavailability, bugs duly reported by the Customer or noted by MBB may be subject to a time extension in proportion to the duration of the damage suffered and / or a possible upgrade.
No refund, even partial, or credit, will be made.

In case of doubt preceding the transaction, it is the Customer's responsibility to contact MBB to obtain the necessary details, either by the contact form accessible from the home page, or by email: contact@monbobateau.eu.
The Customer is reminded that a free Plan is offered to him in the "Plan" and "Manage my Plans" pages without renewal limitation which offers, within the limits of its characteristics, the same operation as the paid Plans. Where applicable, the Customer may submit any complaint by contacting the company using the contact details given at the top of these T & Cs.

In accordance with the provisions of art. L. 611-1 to L. 616-3 of the Consumer Code (France), the Customer is informed that he may have recourse to a consumer mediator under the conditions provided for in Title I of Book VI of the Code of consumption (France).

French law applies to this contract. In the absence of an amicable resolution of a dispute between the parties, only the Commercial Court of Nantes (France) will be competent.
